Certification Introduction
When exporting motor vehicles and their components to the US market, products must meet the mandatory safety compliance requirements of the National Highway Traffic Safety Administration (NHTSA) under the US Department of Transportation (DOT). This system adopts the "manufacturer self-certification + official market sampling inspection" mode, covering complete motor vehicles and most key components including tires, lamps, brake components and safety glass. It is a legal prerequisite for products to enter the US market, and some environmentally related projects also need to meet additional requirements from the US Environmental Protection Agency (EPA).
Laws and Regulations
The core regulation is the Federal Motor Vehicle Safety Standards (FMVSS), developed and updated by NHTSA. All compliance requirements are centered on corresponding FMVSS clauses. In addition to safety requirements, products such as tires also need to comply with EPA's environmental regulations on rolling resistance labels. NHTSA has law enforcement authority for market sampling inspection, violation penalties, and mandatory recalls. Non-compliant products may be subject to high fines and mandatory recall.
Technical Requirements
- Different products correspond to different FMVSS standards, and core commonly used standards include: FMVSS No.108 (lamps), FMVSS No.105/135 (brake systems), FMVSS No.119/139 (tires), FMVSS No.205 (safety glass), FMVSS No.302 (interior flammability resistance)
- Products must pass tests that meet FMVSS requirements, and all test data must be completely retained
- Mandatory certified products must be marked with the DOT marking per specifications; tires must have the exclusive factory code molded, and tires also need to bear rolling resistance and wet grip grade labels required by EPA
- Raw materials must meet the chemical limit requirements for lead, phthalates and other substances specified by FMVSS
Certification Process
- Confirm the applicable FMVSS standard for the product; foreign manufacturers shall appoint a local US agent, complete manufacturer information registration with NHTSA, and apply for an exclusive factory code for tire products
- Entrust a qualified laboratory to complete product performance and safety testing in accordance with the corresponding FMVSS standards
- The manufacturer issues a self-declaration of conformity, confirming that the product complies with all applicable standards
- Mark the DOT marking and relevant compliance information on the product as required, retain test reports and technical documents for at least 5 years, and accept NHTSA market sampling inspections
