Certification Introduction
For construction machinery exported to India, according to the latest policy of the Ministry of Heavy Industries of India in 2026, the mandatory certification requirement for construction machinery originally planned to be included in the Bureau of Indian Standards (BIS) Scheme-X mandatory certification system has been canceled. Enterprises can launch their products in the Indian market without applying for BIS certification, which greatly reduces compliance costs. The cancellation of mandatory certification does not mean relaxation of product quality requirements. Enterprises still need to meet India's basic safety requirements and continue to pay attention to subsequent policy adjustments from Indian regulatory authorities.
Laws and Regulations
The core regulation is Order No. S.O. 239(E) issued by the Ministry of Heavy Industries of India on January 16, 2026, which officially repeals the Safety of Mechanical and Electrical Equipment (Overall Technical Regulation) Order (2024) (OTR), and the repeal order takes effect immediately. ※ Enterprises still need to comply with the safety requirements for the installation and use of industrial machinery under India's Factories Act. If some special sub-segment construction machinery are included in other Quality Control Orders (QCO) subsequently, they must implement compliance requirements in accordance with the corresponding regulations. Technical Requirements
General Safety Requirements Refer to Indian standard IS 11328, and the electrical system shall comply with IS/IEC 60204-1 standard.
Hazardous rotating and cutting parts Must be equipped with reliable protective devices, and the equipment cannot be started if protection is not installed.
Electrical cabinet protection The protection level shall not be lower than IP54, the emergency stop device is a red mushroom head, complying with the requirements of ISO 13850.
The continuous noise at the operator's work station shall not exceed 85 decibels, and the peak impact noise shall not exceed 140 decibels.
Safety warning signs Shall include English and at least one official Indian language, and the grounding wire shall be marked with green and yellow double colors.
Load-bearing components Shall provide material strength certificates that comply with Indian standards.
Certification Process
Enterprises first check the latest mandatory certification product catalog on the official BIS website, confirm whether the product belongs to the mandatory certification category;
If no mandatory certification is required, enterprises shall issue a declaration of conformity on their own stating that the product complies with Indian safety standards, and organize technical documents such as design drawings, material certificates, and safety test reports for inspection;
After completing customs clearance procedures, the product can be launched in the Indian market.
