Wanwei | Regulatory Updates: Major Revision of Customs Union Construction Machinery Regulations

The Eurasian Economic Commission adopted Resolution No. 36 on March 13, 2026, formally approving a systematic revision to the Technical Regulation on Safety of Machinery (TR CU 010/2011). The new regulations will come into effect in phases starting from September 1, 2026, bringing significant adjustments to certification requirements for multiple products.

This revision adds definitions for new terms such as "self-propelled machinery" and "mining equipment," further clarifying the application scope between this regulation and other technical regulations like TR CU 031 and TR CU 018. Overall, the core of this revision lies in significantly strengthening certification and regulatory requirements for self-propelled machinery and special-purpose trailers.

1. Upgrade of Certification Methods

Starting from September 1, 2028, the following product categories that previously relied on Declaration of Conformity (DoC) must now obtain a Certificate of Conformity (CoC):

  • industrial transport vehicles without rails;

  • automatic and electric forklifts, stackers;

  • earth-moving, soil improvement, and open-pit mining machinery;

  • road and construction machinery (excluding mechanized tools);

  • municipal utility machinery (excluding fixed-type).

In addition, the new regulations add products requiring certification via certificates, including: personal mobility devices such as electric scooters and unicycles; three-wheeled cargo vehicles; snowplows, etc.

Certification for a Certificate of Conformity (CoC) requires factory inspection and sample testing. Certification bodies will conduct on-site reviews of manufacturers' quality assurance capabilities, verifying production conditions, inspection methods, and consistency control; applicants must also submit samples to designated laboratories for comprehensive testing. Only after both are passed can the certificate be issued. Post-certification supervision inspections are also required at regular intervals.

(Note: For self-propelled machinery with a single batch not exceeding 100 units and undergoing initial certification, a single-batch Declaration of Conformity (DoC) can be applied for under the new regulations, providing a transitionary convenience for small-batch new products.)

2. Strengthened Certification Requirements

1. Identification Number Requirement

Self-propelled machinery and special-purpose trailers must have a unique identification number, which shall be engraved on the frame or non-detachable components in a durable and tamper-proof manner. Modified machinery must retain the original identification number and affix a new one.

2. Technical Description Requirement

In addition to upgrading content requirements for operating documents, the new regulations also add technical description requirements for self-propelled machinery and special-purpose trailers. When applying for certification, a technical description must be submitted as an annex to the Certificate of Conformity, covering key information such as overall dimensions, curb weight and maximum allowable mass, engine model, and power parameters.

3. Change Management

When key product parameters, structure, or production processes change, the certification body must be notified in writing, and the certificate must be reissued if necessary.
